This privacy notice (“Privacy Notice”) for Village Green Management Company LLC (doing business as Village Green) and its affiliates (together, “we,” “us,” or “our“), describes how and why we might access, collect, store, use, and/or share (“process“) your personal information when you use our servicherees (“Services“), including when you visit our websites at https://villagegreen.com/, https://villagegreenmgt.com/, or https://greenworksstudio.com/, or any website of ours that links to this Privacy Notice (collectively, “Sites”), or otherwise engage with us.

We primarily process information on behalf of our property owner clients, including to provide property management, marketing and design services.  This Privacy Notice is not intended to describe how we process personal information on behalf of property owners. We process such personal information in accordance with the relevant property owner’s written instructions, including the applicable terms of our agreement with such property owner.

Questions or concerns? Reading this Privacy Notice will help you understand our data processing practices and your privacy rights and choices. We are responsible for making decisions about how your personal information is processed.   1. WHAT INFORMATION DO WE COLLECT?

We collect personal information that you voluntarily provide, whether expressing interest in our Services, contacting us by phone, email, or in person, or automatically when you use our Sites. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the features you use. The personal information we collect may include the following:

  • Contact Information. Information such as your name, phone number, email address, company and contact preferences.
  • Location Information. Information such as your city, zip code and state, as well as, with your consent where required by applicable law, your .
  • Additional Information. Any additional information you provide to us, including through our contact request form or other communications with us (and the contents of such communications).
  • Device Information. We automatically collect certain device and usage information, including through cookies and similar technologies, when you visit, use, or navigate our Sites, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, general location (based on your IP address), information about how and when you use our Sites (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take, such as which features you use), and other technical information. This information is primarily needed to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes.

  • Business Transfers. We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • To comply with our legal obligations. We may share your personal information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.
  • With your consent. We may otherwise share your personal information with your consent.

 

  1. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

  1. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented technical and organizational security measures designed to protect the security of the personal information we process. However, despite our safeguards and efforts to secure your personal information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your personal information. Although we use reasonable efforts to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment. 

  1. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect, solicit data from, or market to children under 18 years of age. By using the Services, you represent that you are at least 18 years of age. If we learn that we have collected personal information from a child under 18 years of age, we will take reasonable measures to promptly delete such personal information from our records.   1. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Your Rights
You may have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights may include:

  • Right to know whether or not we are processing your personal information
  • Right to access your personal information
  • Right to correct inaccuracies in your personal information
  • Right to delete your personal information
  • Right to obtain a copy of the personal information you previously shared with us in a portable and, to the extent technically feasible, readily useable format
  • Right to opt out of the sale of your personal information or the processing of your personal information if it is used for targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects (“profiling”). We do not sell personal information or process personal data for purposes of targeted advertising or profiling. We therefore do not provide an option to opt out of such processing.

We will not discriminate against you for exercising any of these rights.

How to Exercise Your Rights

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Under certain US state data protection laws, you have the right to appeal our decision if we decline to take action regarding your request. You may do so by replying to our response or emailing us at privacy@villagegreen.com.

Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have personal information in our system. We will only use the personal information provided in your request to verify your identity or authority to make the request. If we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and/or sign a declaration as to your identity under penalty of perjury.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

  1. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.
